On September 24, 2018, the Federal Communications Commisssion (FCC) published
Enforcement Advisory No. 2018-03
(the Advisory)—titled Two-way VHF/UHF radios may not be imported,
advertised, or sold in the United States unless they comply with the
Commission’s rules—in response to “an increase in the manufacturing,
importation, advertising, and sale of two-way VHF/UHF radios that are
not authorized in accordance with the Commission’s rules.”

One item of note in the Advisory is an
Amateur Radio Exception
which appears to disallow the use of uncertified devices by Amateur
Radio Service (ARS) licensees.
